Dem lawmaker moves to ignite Congress action on immigration

WASHINGTON - One of Congress' leading immigrant-rights advocates introduced a bill Tuesday to allow millions of illegal immigrants to become U.S. citizens and end a controversial program that enlists local police to enforce immigration laws.

But the 700-page bill by Rep. Luis Gutierrez, D-Ill., is widely viewed as too liberal to pass.

"I don't think that even Congressman Gutierrez expects his bill to pass," said Harry Pachon, president of the Tomás Rivera Policy Institute at the University of Southern California. "He's showing a willingness to fight. And he's putting pressure on the Obama administration to act."

Administration officials have said they are working on a more moderate, bipartisan, immigration-reform bill to be introduced in the Senate early next year by Sens. Charles Schumer, D-N.Y., and Lindsey Graham, R-S.C. And House Speaker Nancy Pelosi has said that the House will defer to the Senate on immigration reform.

Still, Gutierrez made it clear that he and his allies expect a seat at the negotiating table as lawmakers and the White House seek middle ground on the polarizing issue.

His bill, endorsed by the Congressional Hispanic Caucus, Black Caucus and Asian Pacific American Caucus, also lets Democrats assure Latino voters that reform remains a top priority, despite being sidelined this year by the economy and the push for health-care reform. Congress watchers say that could go a long way to motivating Hispanic voters during next year's midterm elections.

Gutierrez's bill would allow immigrants who are in the country illegally to stay while they apply to become legal residents or citizens. Undocumented immigrants would have to pay a $500 fine and show that they have made a contribution to the country through their work, education, military or community service.

The legislation also calls for the repeal of the controversial 287(g) program, which enlists local police and sheriff's deputies to enforce federal immigration laws. The bill says that only the federal government has the authority to enforce those laws.

"As a candidate for president, Barack Obama promised comprehensive immigration reform, and we have brought him the bill to accomplish this," Gutierrez said Tuesday.

Hispanic voters helped propel Obama into the White House: He won two-thirds of the Hispanic vote in the 2008 presidential race, according to an analysis of exit polls by the Pew Hispanic Center. He beat Sen. John McCain, R-Ariz., overwhelmingly among Hispanic voters despite McCain's generally moderate stance on immigration issues.

"People feel shocked and completely betrayed that any elected official would propose legalizing illegal immigrants, stopping local police from enforcing immigration law, and stopping increased border security when we have over 15 million Americans out of work," said William Gheen of Americans for Legal Immigration Political Action Committee.

Rep. Jeff Flake, R-Ariz., who has co-sponsored immigration-reform bills with Gutierrez in the past, criticized the bill for watering down the penalties that illegal immigrants would face before they could become legal residents. Previous bills have called for a $2,000 fine and required undocumented workers to return to their home countries before returning to the United States.

Although the Senate bill is still being written, it is expected to be far more moderate and impose tougher penalties for illegal immigrants seeking legal status. It also will emphasize border security and could address the issue of how workers flow into and out of the country.

In a meeting last week with The Arizona Republic, Homeland Security Secretary Janet Napolitano said the Obama administration wants a bill that would require illegal immigrants to register with the government, undergo criminal-background checks, pay taxes and learn English, among other requirements. The bill also would include "some process by which, after that, they could apply for naturalization and to citizenship. But not in advance of people who are already waiting," she said.

Rep. Jerry Lewis, R-Calif., said he believes Gutierrez's bill is going nowhere.

"Congressman Gutierrez is an ardent supporter of immigrant rights and has introduced at least 20 major immigration bills in the past 10 years, but none has been cleared by a committee for a vote on the House floor," Lewis said.

But Rep. Raul Grijalva, D-Ariz., said the Gutierrez bill is the right path to reform. "Immigration policy must deal fairly and intelligently with the millions of hard-working, responsible, undocumented workers already in the country," Grijalva said. "Declaring war on the border is not an option."

Eso declaró el congresista demócrata de Illinois, Luis Gutiérez, al confirmar que el martes 15 de diciembre presentará un plan de reforma migratoria en la Cámara Baja que abre las puertas a un proceso legislativo difícil durante los próximos meses de un 2010 que también será escenario de elecciones de medio tiempo.

a oficina de Gutiérrez emitió un aviso de prensa proveyendo los detalles del evento el próximo martes en un salón del Congreso donde se anticipa que cuente con el apoyo de integrantes de las bancadas latina, afroamericana y asiática del Congreso, así como de la bancada progresista.

"Hemos esperado pacientemente por una solución viable a nuestra crisis de inmigración que fuera abordada por este Congreso y por nuestro presidente", declaró Gutiérrez.

Pero "el tiempo de espera se acabó", agregó.

Como se ha dicho que el proceso legislativo comenzará en el Senado, y posteriormente en la Cámara Baja, algunos se preguntan qué busca Gutiérrez al presentar un proyecto en la Cámara Baja cuando en el Senado ni siquiera se ha presentado uno.

Gutiérrez explicó que este proyecto de ley está siendo presentado antes de que el Congreso entre en el periodo de receso por las fiestas de fin de año, de tal manera que no haya excusa para la inacción en el nuevo año".

La medida, agregó, es producto de meses de colaboración con activistas de derechos civiles, organizaciones laborales y miembros del Congreso.

"Es la respuesta a tantos años de dolor -madres separadas de sus hijos, trabajadores explotados, y de seguridad debilitada en la frontera- todo causado por las manos de nuestro resquebrajado sistema de inmigración. Este proyecto dice 'ya basta'y presenta una solución a nuestro deshecho sistema de tal manera que nosotros como nación de inmigrantes podamos estar orgullosos", anotó el representante.

Originalmente la presentación de la medida se había programado para el jueves 17 de diciembre, pero debido a cambios en el calendario legislativo, explicó Gutiérrez, la fecha se adelantó para el martes 15 de diciembre a las 12:30 pm (Hora del Este).

Hasta ahora Gutiérrez no ha ofrecido detalles de la medida insistiendo únicamente en que será amplia, generosa, humanizante y progresista.

En octubre pasado, Gutiérrez lo explicó así: "si no presentamos un proyecto de ley claro, abarcador, y en el cual el pueblo pueda creer, lo que vamos a hacer es desmovilizar a la gente. Hay que darle a la gente esperanza. Si no lo hacemos, no vamos a movilizar a nuestra gente, y no vamos a ganar esta batalla".

Gutiérrez, de hecho, busca con este proyecto un lugar en la mesa de negociaciones. Al proveer un proyecto de contenido "progresista" busca colocarse del lado más liberal del proceso consciente de que la medida que emerja en el Senado, o incluso en la propia Cámara Baja, será más moderada en muchos puntos. Esto le permite campo para maniobrar en cualquier negociación.

Pero nadie puede saltar el puente hasta no llegar al río y en este caso, la medida es un paso inicial de un proceso legislativo que se prometió y que se ha reiterado a lo largo de todo este año.

Al centro de su plan está conceder una vía de legalización a más de doce millones de indocumentados que viven en Estados Unidos, muchos de ellos padres de niños estadounidenses.

Gutiérrrez ha puesto mucho énfasis al tema de la separación familiar no sólo por las deportaciones, sino porque el obsoleto sistema de visas provoca que pasen años antes de que las familias puedan reunirse de manera legal y eso lleva a muchas personas a ingresar a Estados Unidos ilegalmente.

El congresista dijo a Noticiero Telemundo que es su intención que el tiempo de espera por esas visas de reunificación familiar pueda reducirse a seis años.

Otros puntos que se espera contemple el plan son: las medidas DREAM Act y AgJOBS para legalizar estudiantes y trabajadores agrícolas, medidas de seguridad fronteriza y al interior del país correspondientes al Siglo 21, reformar el sistema de visas para que la gente no opte por ingresar ilegalmente a EEUU, una comisión que decida los futuros flujos de trabajadores, y un sistema de verificación de identidad de trabajadores basado en un banco de datos a prueba de errores.

Habrá que esperar para ver si la medida tiene el apoyo de toda la plana mayor del liderazgo demócrata de la Cámara Baja que por los pasados años ha evitado la discusión de la reforma velando por los intereses de congresistas demócratas que les dieron la mayoría y que representan distritos conservadores y que temen que este asunto les suponga perder su escaño, sobre todo ahora que hay elecciones de medio tiempo el año entrante.

La ultima discusión en el Senado fue en el 2007 y la reforma fracasó por oposición bipartidista.

Sin embargo, en los comicios de 2008 Barack Obama prometió que promulgaría una reforma migratoria amplia en su primer año de presidencia, que se cumple el 20 de enero de 2010. El apoyo de los votantes latinos hacia Obama fue abrumador, y mayor aún entre inmigrantes latinos que votaron por primera vez.

Diversos analistas le advierten a los demócratas que decepcionar a estos votantes al no concretarse la reforma migratoria puede tener repercusiones electorales negativas en 2010 y 2012 para los demócratas. En 2010 el partido en el poder suele perder escaños, lo cual también supone un reto en la lucha por mantener apoyo a la reforma.

De otra parte, otros argumentan que los votantes latinos entienden que el presidente está enfrentando diversos temas difíciles a la vez y que le darían el beneficio de la duda aunque un reciente sondeo de Latino Decisions para Impre.com encontró que dos terceras partes de los votantes latinos votarían en contra de los demócratas y de Obama en 2012 si no aprueban la reforma migratoria antes de los comicios de 2010.

El líder de la mayoría demócrata del Senado, Harry Reid, quien enfrenta una dura reelección en Nevada, estado donde el voto latino inmigrante es importante, está interesado en abordar este tema migratorio más temprano que tarde a pesar de la cargada agenda del Senado a partir de enero cuando hay que competir con medidas de creación de empleos, regulaciones financieras, y cambio climático.

En el Senado, Charles Schumer, demócrata de Nueva York que preside el panel de Inmigración, busca apoyo bipartidista para un proyecto no tan progresista. Schumer, entre otras cosas, habló de un sistema biométrico de verificación que muchos temen resulte en una tarjeta nacional de identidad.

Frank Sharry, director ejecutivo de America's Voice, opinó que "junto al Senador demócrata Bob Menéndez en el Senado, el congresista Gutiérrez y el caucus hispano están asegurándose de que las voces de millones de inmigrantes latinos y la demanda de una reforma migratoria, se tomen en serio por una clase política que de lo contrario podría ignorar esas voces".

McCain, Kyl pressing Napolitano on Arpai

Sens. John McCain and Jon Kyl are continuing to press Homeland Security Secretary Janet Napolitano on the decision to limit Maricopa County Sheriff Joe Arpaio's immigration-enforcement authority.

Amid controversy over Arpaio's ongoing crime-suppression sweeps, Immigration and Customs Enforcement dropped the Maricopa County Sheriff's Office from the 287(g) "task force model" that allowed deputies to enforce federal immigration laws on the streets. (The Sheriff's Office still can enforce immigration laws in the jails.) Homeland Security officials have said Arpaio's wide-reaching operations don't align with ICE priorities of targeting only "serious criminal aliens."

McCain and Kyl, both Arizona Republicans, have been exchanging letters with Napolitano on the topic since October.

"It is our desire that (the Department of Homeland Security) continue to have a productive working relationship with its local law-enforcement partners in Arizona," McCain and Kyl wrote last month in their most recent letter. "To that end, we would appreciate a specific response outlining what steps are necessary for all 287(g)-participating jurisdictions within Arizona to take part in the task-force model."

The senators have not received an answer, but on Thursday, Napolitano was asked what it would take for Arpaio's office to rejoin the model.

"It would require them to agree to the standards that the other law-enforcement agencies have agreed to do," Napolitano said during a meeting with reporters and editors at The Arizona Republic.

In other developments:

• Citizens for Responsibility and Ethics in Washington, a government watchdog group, on Wednesday filed an ethics complaint against McCain over his recording of health-care-related robocalls (automated phone calls) in Arkansas, Colorado, Nebraska and North Dakota. In the calls, McCain urged listeners to petition certain senators to support his amendment to block proposed Medicare cuts. CREW argues that the robocalls, paid for by the National Republican Senatorial Committee, violate a Senate rule.

McCain dismissed CREW as "a far-left group" and said the complaint is meritless.

"They might have a beef if I paid for it with Senate money or official money, but that was a political issue paid for with political contributions," McCain said. "It isn't any more complicated than that."

McCain also has made at least two rounds of robocalls to Arizona voters, paid for by his campaign organization Friends of John McCain.

• Kyl was one of five senators on the Senate Judiciary Committee who on Thursday opposed the Free Flow of Information Act of 2009, better known as the media shield bill. Kyl has criticized the measure, which the panel endorsed 14-5, for not providing adequate protection against the disclosure of sensitive national-security information. The full Senate still has to act on legislation.

• Arizona Attorney General Terry Goddard goes back to Washington so often that one might get the impression he is more interested in federal office than the gubernatorial campaign he's exploring. Goddard, a Democrat, was in D.C. from Wednesday to Friday to meet with banking-industry officials about foreclosure issues. He also chatted by phone with McCain about Luke Air Force Base and met with Democratic Reps. Harry Mitchell, Gabrielle Giffords and Ann Kirkpatrick of Arizona on other issues.

Gov. Jan Brewer, the Republican who could face Goddard in next year's election, also was in Washington last week for the official Capitol Christmas tree-lighting ceremony and to meet with the state's delegation members about health-care reform and other issues.

Hacen fuertes acusaciones contra Mary Rose Wilcox

Un gran jurado acusó formalmente a la supervisora del Condado Maricopa, Mary Rose Wilcox, de no haber revelado ciertos intereses y de haber aprobado fondos para la organización sin fines de lucro Chicanos Por La Causa, de la cual recibía préstamos.

Wilcox fue acusada de 36 delitos mayores, incluidos conflicto de intereses, falso testimonio, falsificación y falso testimonio, anunció el martes el fiscal del condado Maricopa, Andrew Thomas, en una conferencia de prensa conjunta con el sheriff Joe Arpaio.

Un gran jurado también acusó formalmente a otro supervisor del Condado Maricopa, Don Stapley, de 22 delitos mayores por fraude, robo, falso testimonio y falsificación en la supuesta malversación de fondos que recaudó para postularse a la presidencia de un grupo defensor nacional.

A su vez, Wilcox participó en las decisiones que se tomaron para entregarle a dicha organización miles de dólares

Wilcox declinó hacer comentarios al respecto. Su abogado tampoco devolvió las llamadas telefónicas.

Todos los años, las autoridades electas del condado deben presentar informes de sus estados financieros a la Secretaría de la Junta de Supervisores el 31 de enero a más tardar, dijo Fran McCarroll, secretaria de la Junta. Dichos formularios se exigen por ley para evitar un conflicto de interés o el surgimiento de alguno.

Una revisión realizada por el periódico The Arizona Republic mostró que Wilcox efectivamente no reveló los préstamos que le otorgó Chicanos Por La Causa. Una vocera de la mencionada organización dijo que Wilcox y su esposo, Earl, recibieron un préstamo de 7,500 dólares en noviembre de 2000, un préstamo por 50 mil en julio de 2005 y otro por 120 mil en octubre de 2008.

Los funcionarios públicos también deben enviar a la Secretaría cartas que detallen los conflictos de interés a medida que estos surjan, dijo McCarroll. Las cartas por lo general exponen el conflicto e indican que el funcionario no participará en temas de la agenda que estén relacionados con dicho conflicto.

Drone to scan waters in fight vs. smuggling

- U.S. Customs and Border Protection on Monday took delivery of its first Predator aircraft drone to scan U.S. waters for smugglers.

The Predator B is expected to begin testing in early 2010 at Cape Canaveral Air Force Station in Florida and be used in the Caribbean to combat drug trafficking.

The plane has an enhanced radar system compared with the Predator B that has been used to combat drug smuggling and movement of illegal immigrants on land borders for four years. CBP operates three drones from Libby Army Airfield in Sierra Vista, Ariz., and two from Grand Forks Air Force Base in North Dakota.

Another Predator B for maritime use is expected at Cape Canaveral in January, said CBP spokesman Juan Munoz-Torres. The agency plans to eventually have 12 drones for land patrols and six for maritime patrols.

The planes can be disassembled and flown in C-130 cargo planes to other locations, but it is unlikely that the first plane will be used in San Diego, Munoz-Torres said. The Southern California seas have been the site of a surge in illegal immigrant smuggling from Mexico.

The plane delivered Monday was made by General Atomics Aeronautical Systems Inc. in Palmdale, north of Los Angeles, for $13.5 million. Future deliveries are expected to cost $11 million to $12 million.

EEUU repatria a más de 1,700 mexicanos diariamente

MÉXICO, D.F.- El gobierno estadounidense deportó en promedio a 1,719 mexicanos indocumentados cada día de los primeros 10 meses de 2009 informó el último boletín de estadísticas migratorias de la Secretaría de Gobernación que hace pública su contabilidad mensual oficial desde el presente año.
La cifra representa un incremento del 7.3% con respecto al mismo período en 2008.
Las temporadas más hostiles que dispararon las cifras fueron la primavera y verano. Tan sólo en el mes de marzo, fueron regresados 69,324 (2,236 cada 24 horas); abril, con 2099 diarios, sumó 62,982 y junio alcanzó las 1,764 deportaciones diariamente para cerrar el general con 53,936.

El mes de octubre fue el más tranquilo: el sumando de 31 días dio a 37,164 paisanos expulsados con alrededor de 1,198 al día.
Con estos números, las autoridades migratorias precisan que las cifras de repatriados en el presente año superaron el medio millón anual pronosticado y suman en sólo 10 meses ya los 522,825, incluyendo 23,500 menores de edad expulsados por 23 puntos oficiales de internamiento terrestre y aéreo hacia México.
Las estadísticas consideran únicamente a los mexicanos detenidos por las autoridades migratorias estadounidenses y que se apegaron al Programa de Repatriación Voluntaria al Interior, el cual es parte del “Memorándum de Entendimiento sobre la Repatriación Segura, Ordenada, Digna y Humana de Nacionales Mexicanos”, firmado el 20 de febrero de 2004 por ambos países.

Se incluye también a los más de 10,000 delincuentes que los diversos gobiernos estatales de Estados Unidos envían a las localidades fronterizas, la mayoría de los cuales – alrededor de 7,000- se concentran en Ciudad Juárez, Chihuahua.
Sin embargo, en números generales, el estado de Baja California es la entidad que recibe al mayor número de deportados con 206,039 a través de Mexicali, Puerta México y Tecate; le sigue Sonora, con 185,277; Tamaulipas, con 63,403; Chihuahua (43,496); Coahuila (14,495) y el Distrito Federal (10,315).
Entre los expulsados sobresalen los hombres adultos con 439,827 mientras que entre las mujeres sólo regresaron a 59,539; los menores varones sin compañía fueron 18,167 y las niñas deportadas alcanzaron apenas las 5,292, en lo que va del año.

Vigilancia aérea para perseguir a indocumentados

Aviones no tripulados comenzarán rastrear a inmigrantes indocumentados y traficantes que intenten ingresar a Estados Unidos por suelo o mar, indicaron autoridades federales.

Denominadas Predadores B o Drones, las dos naves que estarán vigilando la frontera californiana desde esta semana, son el mismo prototipo militar empleado por soldados de EEUU en las guerras de Irak y Afganistán y tiene un costo superior a los cuatro millones de dólares cada uno.

Sin embargo, el uso esta tecnológica ha sido blanco de numerosas criticas por expertos en materia de seguridad tras el derrumbamiento de varias de estas naves, así como fallas de visibilidad durante la noche o frente a malas condiciones climáticas, aspectos que han puesto en duda su efectividad y señalado su alto costo.

En abril de 2006, uno de los dos aviones que se destinaron a resguardar la frontera en Arizona se estrelló contra una colina al norte de Nogales, zona poco poblada en donde por fortuna no se registraron daños a personas o viviendas.

El incidente, se sumó a reportes oficiales que indican que de los 12 Predadores desplegados en Afganistán entre 2001 y 2002 la mitad (6) terminaron estrellándose por fallas humanas o de diseño.

"Esta fue una llamada de atención con la esperanza de todos. El avión se estrelló sin ningún tipo de daños, pero el potencial [de daños] de vehículos y personas sobre el terreno es considerable ", dijo Kitty Higgins, miembro de la junta de La National Transportation Safety Board (NTS en su presentación.

Marc Herold de la Universiad de New Hampshire afirma que el prototipo de aviones a control remoto no ha demostrado una alta efectividad en el terreno de guerra, ya que de la flota de 48 Drones, el 12% se han perdido por errores técnicos, una inversión que recae en los contribuyentes.

Pero las autoridades migratorias calificaron esta tecnológica como un arma excepcional. Michael Kostelnik, comisionado adjunto de la Oficina de Aire y Marina de la Oficina de Aduanas y Protección Fronteriza (CBP), indicó que tras finalizar la Operación Escudo Imperio en la frontera con Canadá, las aeronaves no tripuladas excedieron los objetivos planteados al demostrar la capacidad de volar por más de 20 horas, es decir, aproximadamente el doble de la resistencia de la mayoría de los aviones tripulados.

Además, CBP estableció un hito al operar tres aeronaves simultáneamente en el espacio aéreo nacional a través de satélite, indicó Kostelnik en su informe.

Los Drones serán manipulados por un equipo de dos personas, uno para el manejo de la aeronave y el otro para manipulación de cámaras y censores de radar, informaron funcionarios ayer durante una rueda de prensa.

Actualmente, CBP cuenta con seis aviones Predadores B, equipados con visores ópticos, uso de radares y cámaras de video de largo alcance para detectar contrabandistas en mar y tierra.

De acuerdo a los planes desvelados, las aeronaves vuelan a una altura de 19,000 pies y pueden transportar hasta 3,000 libras de censores de tierra y marítimos.

Por su parte, organizaciones pro inmigrantes catalogaron la medida como una táctica más del gobierno federal para militarizar la frontera.

"Hay una validez por cuestiones antiterroristas. La seguridad en el país es algo que nos concierne a todos, pero así como están poniendo tanto esmero en la militarización de la frontera y en recurrir a tácticas de guerra deben ponerlo en avanzar una política migratoria en donde hasta hoy se no ha resuelto nada", comentó Marvin Andrade, director ejecutivo del Centro de Recursos Centroamericanos (CARECEN).

Andrade calificó la estrategia federal como un doble discurso al proclamar por un lado necesitamos inmigrantes y al mismo tiempo hacer todo lo posible por evitar la llegada de extranjeros bajo una bandera de lucha contra el terrorismo y ahora el narcotráfico.

"La lucha al narcotráfico no se va acabar sólo con esto, hay mucho trabajo en la educación a nuestros jóvenes y la educación comunitaria", apuntó.

En tanto, organizaciones como el grupo Minuteman aplaudió el operativo aéreo "El avión no tripulado será una herramienta de vigilancia muy eficaz", expresó Britt Craig, un miembro del grupo Minuteman.

La inmigración de indocumentados hacia Estados Unidos ha tenido una caída histórica del 18% al registrarse un descenso en el número de intentos de cruces de 859 mil a 705 mil el pasado ciclo fiscal.

Congreso discute área de seguridad de reforma migratoria

WASHINGTON, D.C.- En una audiencia del Comité Judicial del Senado, la Secretaria de Seguridad Interna, Janet Napolitano, especificó los elementos que una reforma migratoria debe tener en el área de protección del país. Entre ellos mencionó "recursos duraderos y dedicados a la frontera y herramientas legales críticas que no tenemos a nuestra disposición en la actualidad".
Napolitano puso como ejemplos, leyes más duras anti-tráfico que permitan lidiar con crímenes como asaltos a oficiales, poner en peligro a niños, amenazas a familiares y abandonar a personas en el desierto. "También necesitamos actualizar las leyes que no cubren algunas de las nuevas actividades por medio de las cuales los criminales conducen sus negocios".

A su vez, la Secretaria de Seguridad Interna aseguró que necesitan mejoras a la legislación vigente en la ejecución de la seguridad al interior y lugares de trabajo. En este sentido mencionó factores como la ignorancia deliberada de empleadores respecto a las multas por contratar a inmigrantes indocumentados, las que además calificó como muy bajas.
Napolitano es la persona designada por la Casa Blanca para mover el debate de reforma migratoria, una legislación que se espera sea introducida en el Senado durante los primeros meses del 2010.

Struggles of the second generation

Javier Saavedra slumped his burly frame into a worn, plaid couch in the cramped basement room he shares with his girlfriend and their 2-year-old daughter, his expression darkening as he ticked off all the wrong turns that had gotten them stuck below the economy's ground floor.

Raised by Mexican immigrant parents, Saavedra was a gang member by 13, a high school dropout by 16 and a father by 21. Now 23, he has been trying to turn his life around since his daughter, Julissa, was born.

But without a high school diploma, Saavedra was unable to find a job that paid enough for him and his girlfriend, Mayra Hererra, 20 and pregnant with their second child, to move out of her parents' brick home in Hyattsville.

Even the dim, wood-paneled room piled with baby toys and large plastic bags of clothing was costing them $350 a month.

"I get so upset with myself," Saavedra said. "I should have a better chance at a job [than our parents]. I want to be helping them with their bills, not them still helping me."

Millions of children of Latino immigrants are confronting the same challenge as they come of age in one of the most difficult economic climates in decades.

Whether they succeed will have consequences far beyond immigrant circles. As a result of the arrival of more than 20 million mostly Mexican and Central American newcomers in a wave that swelled in the 1970s and soared during the 1990s, the offspring of Latino immigrants now account for one of every 10 children, both in the United States and the Washington region.

Largely because of the growth of this second generation, Latino immigrants and their U.S.-born children and grandchildren will represent almost a third of the nation's working-age adults by mid-century, according to projections from U.S. Census Bureau data by Jeffrey S. Passel, a demographer with the nonpartisan Pew Hispanic Center in Washington.

Not since the last great wave of immigration to the United States around 1900 has the country's economic future been so closely entwined with the generational progress of an immigrant group. And so far, on nearly every measure, the news is troubling.

Second-generation Latinos have the highest high school dropout rate -- one in seven -- of any U.S.-born racial or ethnic group and the highest teen pregnancy rate. These Latinos also receive far fewer college degrees and make significantly less money than non-Hispanic whites and other second-generation immigrants.

Their struggles have fueled an outcry for stricter immigration laws, with advocates saying that the rapid increase in Latino immigrants and their children has strained the United States' resources and social fabric.

"The last 30 years of immigration have made our country more unequal, poorer than we would have been otherwise, more fractious and less cohesive," said Mark Krikorian, executive director of the Center for Immigration Studies in Washington, which favors tighter restrictions on immigration.

Supporters of Latino immigrants say that the newcomers and their children have spurred economic growth and contribute far more to society than they take from it. They also note that even a complete halt to future immigration would not change the footprint of the 15.5 million U.S.-born offspring of Latino immigrants already in the country.

Perhaps the only yardstick by which the second generation has achieved unambiguous success is the one that has stirred the most public controversy: English proficiency. Despite fears among some people that English usage is diminishing in the Latino community, census data and several studies indicate that by the second generation, nearly all Latinos are fluent in English and that by the third generation, few can even speak Spanish.

The second generation's lack of success on educational and economic fronts is largely explained by their immigrant parents' extremely low starting point. Forty percent of second-generation Latino children are born to parents who never completed high school. Only 12 percent have a parent with a college degree or higher.

Saavedra's parents, who entered the United States illegally but later obtained legal permanent residency, didn't get beyond the third grade in Mexico. They were often at a loss when it came to helping him with homework. "They didn't even know how to get you the stuff you needed" for science projects, he said.

Although adding on a year or two of education beyond high school can boost their incomes, to be truly guaranteed a middle-class lifestyle, second-generation Latinos need at least a bachelor's degree -- a feat that the last major wave of immigrants, from Eastern and Southern Europe, took three or four generations to achieve.

"The second generation is doing way better" than their parents, said Ruben Rumbaut, a professor at the University of California at Irvine and a leading scholar on second-generation Latino immigrants. "But way better can still mean they are high school dropouts with 11 years of education, as opposed to their parents, with six years. And in this economy, an 11th-grade dropout is not going to make it."

Rage and remorse

Saavedra is determined to be the exception, although he knows it won't be easy.

The sun was burning down from a late-April sky, and Saavedra's brow filled with sweat as he mixed cement with a shovel at a Northern Virginia construction site.

When he was a child, his father would sometimes take him to sites like this in hopes of motivating the boy to stay in school.

"He used to say to me, 'What do you think is heavier: the pencil or the shovel?' " Saavedra recalled.

Still, this was the first work he had gotten in a month, and he seemed eager to show his gratitude to his girlfriend's Mexican-born father for taking him along. He sprang quickly to lug the heaviest equipment and joked in Spanish with the slender immigrant working alongside him.

"Somos como 'El Gordo y La Flaca' " -- We're like 'The Fat Man and the Skinny Lady' -- said Saavedra, referring to a popular TV talk show.

Yet for all his cheer, Saavedra knew that the one-day, $12-per-hour assignment to build a trash lot behind a hotel wouldn't cover his and Herrera's $106 cellphone bill.

And even Saavedra's outfit -- sparkly stud earrings, a basketball jersey that fell to his thighs and baggy pants that ballooned around his ankles -- broadcast his gnawing sense that he didn't belong among the crew of Mexican immigrants.

Technically, he is what researchers call a "1.5-generation" immigrant, because he was born in Mexico and moved to the United States as a 4-year-old. But with no memory of living anywhere other than Maryland, Saavedra considers himself, and tries to dress like, a member of the second generation.

He hauled an 80-pound bag of cement onto his shoulder and cracked a grin that was half-smirk, half-wince.

"It's times like these," he said, "that I think, 'Oh, man! Why didn't I finish high school?' "

The short answer is that he joined a gang and was kicked out of Bladensburg High School for fighting in his sophomore year. The long answer, Saavedra said, is that he was too filled with rage to put much stock in school.

The youngest boy in a family of seven children, he said he grew up fearing his father's temper and often felt ignored by his parents. "You know, like they'd buy [my older brother] Air Jordans but say there wasn't enough to buy them for me."

School offered little solace. As his family moved around Prince George's County, Saavedra passed through five elementary schools. Each time he started a new school, he said, "people tried jumping me and saying, 'Oh, you're the new guy.' . . . The hate started building up in my heart until I just got so tired."

By the time he got to William Wirt Middle School in Riverdale, Saavedra was an eager recruit for the Latino gangs that held sway there. He soon started his own clique of the gang Sur 13, transforming himself from his family's invisible youngest son to Casper, the nickname he chose as leader of some of the toughest guys in the neighborhood.

"All my life," he said, "I've always wanted to be known for something."

Hererra, who met Saavedra at a family party and started dating him in high school, said she wished the rest of the world could see the kind, thoughtful side of his personality he reserved for her. "Towards me he'd show emotion," she said. "He was always so attentive. . . . But towards everyone else, he'd just show anger."

Although Saavedra listened respectfully to her pleas to leave the gang, he didn't start reconsidering his choices until months after he had left high school. Without a diploma, he was cycling through low-paying, occasional jobs: cleaning carpets, driving for FedEx, working construction.

Friends started getting killed, including Edward Trujillo, a gang leader whom Saavedra had looked up to as a boy. He was gunned down on a residential street in the Riverdale area.

Saavedra himself narrowly missed being shot on four occasions. And he was constantly in brawls. "Some guy would call at 2 in the morning about a fight, and he'd be off," Hererra said.

Although Saavedra was not convicted of any crimes, he was picked up multiple times on suspicion of vandalism, assault and theft. Sgt. George Norris, a member of the Prince George's police gang unit, said he made a point of pulling Saavedra over for questioning and locking him up when possible. When Saavedra moved, Norris surprised him by turning up at the new address.

"I wanted him to know that wherever he went, whatever he did, I was going to be there," Norris said.

But after Saavedra decided to get free therapy from a local youth group, Norris also offered support, inviting him to speak at conferences and berating him when he showed signs of slipping back into gang life.

The hour-a-week therapy sessions helped Saavedra get more of a handle on his temper.

Perhaps most significantly, Hererra became pregnant and threatened to leave him if he didn't put the safety of their child first.

All in all, "it took him a good year to come around," she said. "He wasn't really changed until he saw the baby being born."

Progress and setbacks

Some weeks after the construction job, Saavedra lay on an operating table in Bethesda, tensing his torso as a doctor traced a laser over a tattoo of a teardrop just below his eye.

With funding from a local youth group called Identity, he had already had a number of his old gang tattoos removed, including the large, black SUR in gothic letters on his right arm, and the 13 written on his left. The teardrops would be the last to go.

"Without this on my face, I can probably get a better job," he said as he walked out of the doctor's office carrying Julissa's sippy cup in one hand and her pink diaper bag in the other. "I won't be getting pulled over for looking suspicious. People won't be thinking, 'Oh, he must've murdered someone.' "

Still, Saavedra said, he sometimes misses the status of being a gang leader. But he had recently hit on what seemed a perfect way to fill the void: a club of mostly former gang members who trick out lowrider bicycles with velvet seats, chrome wheels, twisted metal handlebars and plaques decorated with the gothic letters and fearsome imagery popular with Latino gangs.

Saavedra said he also hopes the club, called Street Nations, will offer his nephews and other young boys an alternative to joining a gang. "They like the gang lifestyle. But I be trying to tell them, 'It's not cool. If you want to be in gangs, later on you'll regret it.' "

A few days later, Saavedra took extra-small T-shirts printed with the Street Nations logo to give to his nephews at the club's first official meeting in a Riverdale park.

Hererra chuckled at the sight of the couple's youngest nephew posing for photographs next to the group's heavily tattooed, pierced older members. "Chris!" Saavedra shouted at the 8-year-old. "Stay in school and you get a bike!"

Saavedra and Hererra were trying to make their own educations a priority as well.

Despite her pregnancy, Hererra had continued to take classes toward a business degree at a Northern Virginia vocational college. Now 21, she hopes to graduate next year and get a job in human resources.

Saavedra had subscribed to an online course to work toward a high school diploma. His plan was to do a lesson a week on the computer next to his and Hererra's bed in the basement.

But Saavedra ended up whiling away his time updating the Street Nations Web site and chatting with other members on its message board -- "your Twitter," Hererra called it.

By summer's end, the online course was all but forgotten. FedEx had come through with a steady delivery job, and between the 12-hour workdays and evenings taking care of Julissa and his newborn son, Anthony Javier, so Hererra could go to class, Saavedra said, "I'm not even focused on my GED right now."

At $500 a week, his wages still aren't enough for the couple to get a place of their own. There are nights when Saavedra wonders whether they ever will.

"I try to stay positive," Saavedra said. "But sometimes inside me, I just feel like giving up and running away from this. You know, just getting lost. Honestly, sometimes that's just how I feel."

La Liga de Ciudades y Pueblos de Arizona presentó esta semana una demanda ante la Corte Suprema de ese estado para que queden eliminadas algunas secciones de la nueva ley estatal, que obliga a los departamentos que otorgan asistencia pública a verificar el estatus migratorio de los solicitantes.

Ello incluiría el programa de seguro médico conocido por sus siglas en inglés como AHCCCS.

Las nuevas regulaciones obligarán a los funcionarios a denunciar a los solicitantes que no tengan en regla sus documentos de inmigración, y de no hacerlo podrían ser sancionados.

En su demanda, la Liga expresó su temor a las consecuencias legales que esta nueva ley podría tener para las ciudades, que podrían ser demandas.

Los inmigrantes indocumentados han sido el blanco de una serie de leyes estatales en Arizona, entre ellas la ley de sanciones a empleadores, que penaliza a los negocios que contratan inmigrantes indocumentados.

En Arizona los estudiantes indocumentados deben pagar la inscripción académica como alumnos extranjeros en colegios y universidades públicas.

Informe destaca papel de inmigrantes en economía de Estados Unidos

Un informe emitido el lunes en Nueva York indicó que los inmigrantes juegan un papel clave en la economía nacional y citó a Miami entre las 10 primeras zonas metropolitanas con un número importante de inmigrantes dentro de la población laboral.

Los inmigrantes y la economía, publicado por el Instituto de Política Fiscal en Nueva York, precisó que en el área metropolitana de Miami el porcentaje de inmigrantes en la fuerza laboral es del 45.4

Las 10 principales zonas metropolitanas con inmigrantes mencionadas en el informe son, en este orden, Nueva York, Los Angeles, Chicago, Dallas, Philadelphia, Houston, Miami, Washington, Atlanta y Detroit.

El informe de 52 páginas es el más reciente en una serie de estudios emitidos en momentos en que la administración se prepara para el debate sobre una reforma migratoria luego de la reforma del seguro médico.

El autor del estudio, David Dyssegaard Kallick, director de la iniciativa de investigación sobre inmigración del Instituto de Política Fiscal, dijo que la crisis afecta a inmigrantes y nativos por igual. Un estudio de julio del 2008 del Centro de Estudios de la Inmigración, en Washington, D.C., que aboga por controles migratorios, dijo que operaciones más frecuentes y sistemáticas de la Policía de Inmigración y Aduanas motivaban un descenso en la población de inmigrantes indocumentados.

WASHINGTON, D.C.— El desempleo y no la amnistía pasa a ser el marco en el cual, esta vez, será discutida la reforma migratoria a nivel público. Esto, tras las manifestaciones explícitas de algunos legisladores enfocadas en la economía y cómo afectaría al mercado laboral la legalización de millones de trabajadores inmigrantes.

Este mes, 22 congresistas republicanos del comité judicial de la Cámara de Representantes enviaron una carta al presidente Barack Obama, donde se especifica que "cada vez que la Oficina de Control de Inmigración y Aduanas (ICE) actúa deteniendo y deportando a inmigrantes indocumentados, salva y crea trabajos para los estadounidenses, porque está asegurando que las posiciones ocupadas por los inmigrantes estén abiertas a trabajadores legales".

Por lo tanto, concluye la misiva, "cualquier esfuerzo de la Administración para prevenir que los inmigrantes obtengan posiciones, ayudará a asegurar puestos para los estadounidenses".

Un mensaje similar al que entregó Dan Lungren (R-CA), hace algunos días, cuando habló sobre inmigración en el Woodrow Wilson Center y dijo que "aunque le gustaría decir que la reforma tiene posibilidades en 2010, con este clima económico y laboral es imposible afirmar eso".

Más aún, el 19 de noviembre congresistas republicanos del comité judicial sostuvieron un foro titulado "Trabajos Americanos en Peligro: el Impacto de la Inmigración Descontrolada", donde diversos expertos dieron testimonio en relación con "las consecuencias negativas de la inmigración masiva" de personas con y sin documentos, para los trabajadores estadounidenses.

Este mensaje acompañado de un 10.2% de desempleo a nivel nacional parece estar generando efectos al otro lado del pasillo. De hecho, en la semana el congresista Luis Gutiérrez, reconocido por su posición pro reforma migratoria, pareció demostrarlo.

En un artículo publicado por un medio estadounidense, el congresista dijo que "cada legislación es reflejo de un tiempo y que con el desempleo arriba de 10% se necesita un lenguaje que sea cuidadosamente diseñado".

Consultada por La Opinión la vocera de la oficina de Gutiérrez, Rebecca Dreilinger, explicó que lo que ha asegurado el legislador es consistente con la postura que difundió cuando anunció los principios básicos de la propuesta de reforma migratoria que presentará en diciembre próximo.

Gutiérrez aseguró en esa oportunidad que "los programas de trabajadores temporales funcionan mal y pasan a llevar los derechos de los empleados. Además, los números de visas son determinados por política y no con base en la necesidad laboral y económica. Mi plan creará un sistema de empleo basado en visas que sea justo para empleadores y trabajadores y creará una comisión para alinear el número de visas con la demanda del mercado laboral actual".

En la opinión de Frank Sharry, director ejecutivo de America’s Voice, el mensaje central que se utilizará para oponerse a la reforma será justamente el desempleo. "Están tratando de levantar el argumento de los intereses de los inmigrantes versus los de los estadounidenses en tiempos de crisis. No es un argumento substancial y solamente busca crear temor en la población", aseguró.

"De acuerdo con los números que hemos estado viendo, los votantes que cambian de un partido a otro, ellos están más interesados en soluciones que en la polarización", agregó.

En un reporte sobre votantes independientes y reforma migratoria publicado por America’s Voice en junio, sólo un 29% respondió estar de acuerdo con que el país estaría mejor si los inmigrantes indocumentados se fueran, ya que "roban" trabajos a los estadounidenses, mientras un 68% dijo que preferiría que este grupo pagara impuestos.

Municipalities sue to stop state's immigration policy

Gov. Jan Brewer, flanked by key state legislators, reacted with shock Tuesday to a lawsuit by cities and towns and accused the local officials of coddling illegal immigrants at state expense.

But the lawsuit disputes how state officials enacted the wide-ranging law, not the substance of the law itself.

At issue is a lawsuit filed with the state Supreme Court Monday by the League of Arizona Cities and Towns. It argues that the Legislature unconstitutionally approved policy changes that affect local development practices as well as how cities enforce requirements that people show proof of citizenship to receive government benefits.

The measures were included in a budget bill lawmakers approved this summer during a special session called to deal with the state budget deficit and a possible sales-tax referendum.

Wrapping the policy changes into an appropriations bill violates the state Constitution, the cities charge.

But Brewer said she reads the lawsuit as an attempt to lighten restrictions on illegal immigrants, a move she said is especially heinous given the state's billion-dollar budget deficits.

"Our policy will be to prevent benefits to illegal immigrants," she said.

The cities agree with that policy, said Ken Strobeck, executive director of the league, which represents 90 cities and towns.

"The law is already clear in Arizona that cities and towns don't provide services to illegal immigrants," Strobeck said.

But the cities fear that the new law, which took effect Tuesday, will trigger a flood of lawsuits because it allows anyone to take a city or town to court if they believe the local government provided a public benefit. That could be interpreted as something as simple as a library card, or perhaps even the use of a city street or sidewalk, municipal officials fear.

The cities lobbied against this provision when it was debated during the Legislature's regular session. It did not pass.

But it was tucked into a budget bill during a special session and that violates the Constitution's single-subject rule, the cities allege. It also falls outside the scope of the budget-themed special session that Brewer called in July. The lawsuit applies the same argument to other parts of House Bill 2008 that impose a two-year freeze on development fees and building-code revisions.

The Supreme Court will consider the cities' request for a stay of action Tuesday.

Joining Brewer at her news conference were House Speaker Kirk Adams, R-Mesa, Senate President Bob Burns, R-Peoria, and Sen. Russell Pearce, R-Mesa, who has been the Legislature's most outspoken critic of illegal immigration.

Adams called the cities' lawsuit a "cynical" move and noted that not one city representative testified against the bill when it came before the Appropriations Committee in special session.

Strobeck said that's because it was a last-minute change that came with no notice.

The legislative record shows that the bill was introduced on July 29, passed the Appropriations Committee the same day, and was approved by the full House of Representatives July 31.

La Inmigración Indocumentada Nunca Va A Terminar

El debate en nuestra comunidad sobre la reforma migratoria ya comenzó y es un debate serio y muy saludable.

Hemos escuchado los dichos como, "En la unión esta la fuerza" o como dijo Shakespeare, "Uno para todos, y todos para uno." Pero hay lideres que erróneamente piden unidad, pero en realidad lo que están pidiendo es que el resto de la comunidad se una ellos y no ellos al resto de la comunidad. ¡La unidad no se pide, se gana! Y se gana automáticamente cuando la idea o la postura es la mejor.

Las personas y líderes que están a favor del plan de trabajadores temporales aseguran que ese plan va a terminar con la inmigración indocumentada. Pero que pensamiento tan más chiflado, demente y equivocado.

La inmigración indocumentada nunca va a terminar. ¡Repito! La inmigración indocumentada nunca va a terminar.

Solamente los que hemos sufrido hambre podemos entender que el hambre es mas fuerte que el mido. El problema de la inmigración indocumentada radica en una ecuación económica de oferta y demanda. Mientras haya desempleados o gente ganando $5 dólares al día en México y el resto de America Latina, y trabajos para ellos en Estados Unidos donde pueden ganar eso mismo en menos de una hora, seguirá existiendo inmigración indocumentada.
